Negotiating a Conduct and Compensation Agreement

If a resource company wishes to access private land to undertake advanced activities (such as levelling, trenching, constructing or excavating) it must follow the Land Access Code.

This involves discussing the proposed activities with the landholder before negotiating a Conduct and Compensation Agreement (CCA).

Make good agreements for bore owners

Resources companies are required to take a number of steps to ensure bore owners are not disadvantaged by their operations.

All authorised private water bores within the immediately affected area of gas operations are assessed by the company to determine if their activities have impaired the capacity of the bores or are likely to impair them in the future.

A make good agreement is then negotiated between the resource company and bore owner.

Options for dispute resolution

There's a range of options available to help parties reach agreements if land access or make good negotiations become challenging.
